General Terms and Conditions – Good Design Call

These Terms and Conditions apply exclusively to the Good Design Call (1:1 online consultation "Good Design Call" and 1:1 online consultation "Good Design Focus Call"). Separate, project-specific terms apply to further-reaching design projects. By making payment, you accept these Terms and Conditions.

1. Scope and provider
These General Terms and Conditions ("Terms") apply to the GOOD DESIGN CALL, a 1:1 online consultation format offered by GOOD DESIGN – Avelina Stefanie Gut (hereinafter "GOOD DESIGN"). By booking the Good Design Call via the website, the booking system or by e-mail, customers accept these Terms.

2. Conclusion of contract and booking
Bookings are made online via the booking system or by e-mail. Once payment has been made successfully, the appointment is bindingly booked. No appointment is allocated without payment. GOOD DESIGN reserves the right to decline bookings in exceptional cases.

3. Scope of services
The Good Design Call is a time-limited consultation format (currently 60 minutes via Zoom) for the analysis, design consultation and strategic assessment of properties and projects. The service comprises verbal recommendations, assessments and creative suggestions. The content discussed during the call is subsequently sent by e-mail as a summary (PDF).
GOOD DESIGN does not owe any particular structural or economic result, but exclusively advice and design recommendations.

4. Limitation of services
The Good Design Call does not include, in particular:
– the creation of plans, technical drawings, visualisations or written concepts,
– architectural or technical planning,
– any obligation to implement – all implementation decisions rest with the customer.

5. Prices and payment
All prices are in euros including statutory value-added tax (VAT). The Good Design Call must be paid in full in advance online. The appointment is only bindingly reserved once payment has been received.

6. Rebooking and cancellation
Rebookings and cancellations are possible exclusively by e-mail to office@gooddesign.at:
– up to 24 hours before the appointment: free of charge (rebooking or cancellation),
– within 24 hours before the appointment: 100% of the price will be charged,
– non-attendance (no-show): 100% of the price – a refund is excluded.
If GOOD DESIGN has to postpone an appointment for good cause, an alternative appointment will be offered without delay. If no alternative appointment is possible, the amount paid will be refunded in full.

7. Right of withdrawal (digital/scheduled service)
For contracts concluded via distance selling, consumers generally have a 14-day right of withdrawal (§ 11 of the Austrian Distance and Off-Premises Business Act, FAGG). The Good Design Call is a scheduled service performed at the express request of the customer.
By booking, customers expressly agree that the service will be performed before the expiry of the 14-day withdrawal period, and acknowledge that the right of withdrawal expires upon complete performance of the service (§ 16 FAGG).

8. Customer duties to cooperate
To enable professional consultation, customers undertake to provide all relevant documents (floor plans, photos, measurements, information) in good time – no later than 24 hours before the appointment – and to provide accurate information. GOOD DESIGN is not liable for the accuracy of the documents provided or for delays caused by missing or late documents.

9. Vouchers
Vouchers are redeemed in the booking form by entering the voucher code; the voucher value is deducted from the price. The validity date stated on the respective voucher applies. One voucher may be redeemed per booking. A cash payout or refund of the voucher value is excluded.

10. Credit towards follow-up projects
If a further-reaching project is commissioned from GOOD DESIGN within three months of the Good Design Call, the fee for the call will be credited towards the follow-up project. The credit is applied as a discount on the new service and does not constitute a refund.

11. Rights of use and copyright
All ideas, recommendations, concepts, sketches and other content of the call remain entirely the intellectual property of GOOD DESIGN. The copyright to all work developed in the course of the call remains exclusively with GOOD DESIGN. Customers receive a simple (non-exclusive) right of use, exclusively for their own private or business property. Without prior written consent, the following are in particular not permitted: disclosure to third parties, commercial use, publication, sale, reproduction, and use for other properties.
GOOD DESIGN is entitled to use and publish the work, concepts and results developed in the course of the call, as well as images provided or created, for its own purposes – in particular for presentation in its portfolio, on its website and on social media. This is done exclusively in anonymised form: the customer's name, address and other personal data will not be mentioned and will be rendered unrecognisable. Customers may object to such use at any time without any formal requirements.

12. Liability
GOOD DESIGN provides the consultation to the best of its knowledge and belief and is liable exclusively for gross negligence or intent. In particular, construction work, structural decisions, electrical planning, regulatory matters and craftsmanship are not covered. No liability is accepted for implementation by third parties (tradespeople, specialists, master builders, etc.) or for decisions and purchases made by the customer on their own responsibility.

13. Data protection
Personal data is processed exclusively within the framework of the GDPR. The complete privacy policy is available on the website at www.gooddesign.at.

14. Final provisions
Austrian law applies. Mandatory, more favourable protective provisions of the consumer's country of residence remain unaffected. The place of jurisdiction for disputes with businesses (entrepreneurs) is Vienna. Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
